Who we are

Where we rely on legitimate interest (Art. 6(1)(f) GDPR), we have conducted a balancing assessment and consider the processing necessary and proportionate. You may request a summary by email.

What we do not collect

Your audio content never leaves your browser. File names and duration are transmitted to generate your checkout; the audio itself is not uploaded. We do not create user accounts and we do not store passwords. Our analytics hold no direct identifiers: no email, no name, no phone number, and no IP address (not even a hashed or shortened one). Your email lives only with Stripe, for payments. We do not build persistent profiles tied to your identity, we do not track you across other websites, and we use no fingerprinting and no marketing cookies.

How our analytics work

We measure how the service is used so we can improve it. This is first-party, privacy-preserving analytics. Here is exactly what that means.

  • We record which pages are viewed, how far they are read, the steps of the upload and checkout flow, anonymous outcomes such as whether a file passed or failed and the measured ACX figures (loudness, peak, noise floor, silence, format), and coarse error types when something breaks.
  • The measured ACX figures are numbers your browser already computed. No audio, no filename, and no waveform ever leaves your device.
  • We see only coarse context: a two-letter country code (from Cloudflare) and a broad device class (mobile, tablet, or desktop). No city, no precise location, no fingerprinting.
  • To stitch a single visit together we use a temporary session identifier held in your browser's sessionStorage (key cp_sid). It is a random value, it is not a cookie, and it is regenerated each time you start a new browser session. It does not follow you between visits and is not tied to your identity.
  • Events are stored in Cloudflare Analytics Engine. The small number of conversion events (such as checkout and download) are also kept in our own database for longer-term reporting. We additionally send the same events to Google Analytics 4 as a cross-check. Google Analytics is configured to run without cookies or any other storage on your device.

We rely on legitimate interest (Art. 6(1)(f) GDPR) for this analytics, because it uses no direct identifiers, builds no cross-session or cross-site profile, and is limited to understanding and improving our own service. You can object to it at any time by emailing info@chapterpass.com.

Cookies and similar technologies

chapterpass sets no analytics or marketing cookies. Our analytics use no cookies at all. The session identifier described above lives in your browser's sessionStorage, not in a cookie, and it clears when your browser session ends. Google Analytics is configured to run without cookies or any other storage on your device.

Stripe may set cookies that are strictly necessary for payment processing and fraud detection. Cloudflare may set a security cookie (__cf_bm) for bot management. These are strictly necessary technologies that do not require consent under the ePrivacy Directive.

Your rights

Under GDPR, you have the right to:

  • Access the personal data we hold about you
  • Rectify inaccurate data
  • Request erasure of your data
  • Request restriction of processing
  • Data portability
  • Object to processing based on legitimate interest

To exercise any of these rights, email us at info@chapterpass.com. You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali). UK residents may also lodge a complaint with the UK Information Commissioner's Office.

International transfers

Personal data may be transferred to the United States through our processors (Stripe, Cloudflare, Google Analytics, and Web3Forms). Transfers are protected by the EU-US Data Privacy Framework and by Standard Contractual Clauses where applicable, which together provide an adequate level of data protection as recognised by the European Commission. Our analytics are designed to carry no direct identifiers, so the analytics data transferred is limited to the coarse, non-identifying events described above.

California residents

chapterpass does not sell or share personal information, as those terms are defined under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). If you are a California resident, you have the right to:

  • Know what personal information we collect and how we use it
  • Request deletion of your personal information
  • Request correction of inaccurate personal information
  • Limit the use of sensitive personal information
  • Not be discriminated against for exercising these rights

Data breach notification

Where a breach of personal data occurs, we will notify the Garante per la Protezione dei Dati Personali within 72 hours in line with Art. 33 GDPR, and will notify affected users without undue delay where the breach poses a high risk to their rights.

We may update this page if our data practices change. The Last updated date at the top of this page reflects the most recent revision.


3. Terms of Service

The service

chapterpass analyses and masters audiobook chapter files to meet ACX and Audible technical specifications. Your audio content never leaves your browser. File names and duration are transmitted to generate your checkout; the audio itself is not uploaded. The quality of the output depends on the quality of your input files.

Pricing and payment

Your first file is free, no payment required. Additional files are priced at $0.01 per second of audio. Prices are listed in US dollars. As a sole trader operating under the Italian regime forfettario, VAT is not charged on these services. You will see the exact total before confirming payment. Payments are processed securely by Stripe.

Right of withdrawal

Under EU consumer protection law, you have a 14-day right of withdrawal for online purchases. Because chapterpass processes your files immediately upon request, you may waive this right by giving explicit consent before processing begins.

Before processing begins you must (i) confirm you consent to immediate processing and (ii) acknowledge you lose your 14-day right of withdrawal. You will receive confirmation of this consent by email.

If you wish to withdraw before processing starts, you may do so using the model withdrawal form (Annex I of Directive 2011/83/EU). Send it by email to info@chapterpass.com.

If a file fails despite meeting our stated input requirements, we will refund. Other refund requests are reviewed on a case-by-case basis. Email info@chapterpass.com to raise a request.

Liability

chapterpass masters files to the published technical specifications of each target platform. Our liability is capped at the amount paid for the specific processing session in question. Beyond that:

  • We do not guarantee acceptance by ACX, Audible, or any other platform.
  • Platform requirements may change without notice.
  • We are not liable for issues caused by the quality of your input files.

Force majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to infrastructure outages, third-party provider failures, regulatory action, and other extraordinary events.

Acceptable use

You agree not to use chapterpass for unlawful content, to process material that infringes the rights of others, to circumvent technical limits of the service, or to run automated scraping or similar activity. We reserve the right to terminate access where use breaches these terms.

Intellectual property

Your audio files remain your property at all times. We never access, store, or retain your audio content. You grant us a non-exclusive, limited licence to process file names and durations solely to deliver the checkout and processing described in this agreement. The chapterpass software, brand, and website content are our intellectual property.

Service availability

We aim for high availability but do not guarantee uninterrupted service. We may update or modify the service at any time. Significant changes will be communicated on this website.

Governing law

These terms are governed by Italian law. If you are an EU consumer, you retain the protections of your home country's mandatory consumer protection rules, regardless of the governing law chosen.

Dispute resolution

We are not compulsorily bound to any alternative dispute resolution (ADR) body under Codice del Consumo Art. 141, but we will consider ADR in good faith where raised by a consumer. You may also make use of the European Commission's Online Dispute Resolution platform.

Changes to these terms

As chapterpass does not operate accounts, changes are communicated through this page. For paying customers, material changes affecting an active order will be notified by email. The Last updated date at the top of this page reflects the most recent revision. Continued use of chapterpass after changes constitutes acceptance of the updated terms.
